Peak Mind Coach — Consumer Health Data Privacy Policy

Effective date: October 22, 2026. Operated by Peak Mind Mechanics LLC, a California limited liability company (“Peak Mind,” “we,” “us”).

This policy explains how we collect, use, share, and protect consumer health data in the Peak Mind Coach app and website, and how you can access, delete, or stop our use of it. It supplements our Privacy Policy; where the two differ on consumer health data, this policy controls. It is written to meet Washington’s My Health My Data Act (RCW ch. 19.373) and Nevada’s consumer health data law (NRS 603A.400–.550), and we apply it to every Peak Mind user, wherever you live.

1. What we mean by consumer health data

Consumer health data is personal information that is linked or reasonably linkable to you and identifies your past, present, or future physical or mental health status. In Peak Mind, that includes your mental-performance assessments, mood and readiness check-ins, wellbeing measures, reflections, sensor data, and anything we infer from them. It does not include data that has been de-identified under Section 7.

2. What we collect, why, and where it comes from

We collect consumer health data only for the purposes listed here. Anything beyond providing the features you use requires your separate consent, which you can withdraw at any time.

3. Who we share it with

We do not sell consumer health data. We share it only as follows:

Recipient categoryWhat they receiveWhy
Service providers (processors)Only what each needs to perform its serviceCloud hosting and database, app delivery, error monitoring, email delivery, and AI model providers that write coaching replies and turn voice into text (OpenAI, Anthropic) plus a voice provider that speaks the coach’s replies (Cartesia), only if you turn on AI coaching. Each is contractually bound to use the data only on our instructions. AI providers (OpenAI, Anthropic and Cartesia) may keep what they receive for a limited period for safety and abuse monitoring under their terms, and may not use it to train their models.
A coach or organization you connectOnly the categories you allow in the app’s Consent CenterYou direct this sharing and can turn it off at any time
Research collaboratorsNone today. If we ever share research data outside Peak Mind, only de-identified data that meets Section 7Only if you turn on Research (Section 4)
A successor companyYour data and your consent choices, togetherOnly in a merger or acquisition where the successor must honor this policy
AuthoritiesWhat the law requiresTo comply with a valid legal order or protect safety

We have no affiliates that receive consumer health data. On request, we give you the name and contact information of every third party that has received your data (Section 5).

4. Research

Research is optional and off unless you turn on Research in Settings. You can turn it off at any time, and turning it on or off never affects your access to the app. We never sell your data.

If you turn it on, Peak Mind uses your assessments, check-ins, readiness scores, background answers, and any heart and sleep data you’ve connected to: (1) compare results across groups of users, such as by sport, experience level or training habits; (2) learn which coaching practices work best, so we can improve the Peak Mind Coach method, content and features; and (3) check that our assessments and tools measure what they are meant to measure. We do not use your journal entries or reflections for research.

Before analysis, we replace your name, email and other direct identifiers with a code. We keep the key that links the code to your account separately, under restricted access, so we can follow changes over time and honor your choices. Because we hold that key, your research data is still consumer health data under this policy, and all your rights in Section 5 apply to it.

Research is done by Peak Mind. We publish or share results only as group statistics that cannot identify you. Our founder may also use de-identified, group-level results in future academic work, including a doctoral thesis. That would happen only after any ethics review the work requires, and if it ever needs identifiable data, we will ask you separately first.

Turning Research on covers data you have already entered and data going forward. If you turn it off, we stop using your data for research from then on. Results already combined into group statistics cannot be reversed.

5. Your rights

You have the right to:

  1. Confirm and access. Learn whether we hold your consumer health data, get a copy, and receive a list of every third party that has received it, with their contact information.
  2. Withdraw consent. Stop any use you consented to, at any time, from Settings or by contacting us. Withdrawal stops future collection and use for that purpose.
  3. Delete. Have your consumer health data deleted from our systems, including backups, and have the deletion passed on to every service provider and third party that received it.
  4. Appeal. Ask us to reconsider if we deny any request.

How to make a request. In the app, go to Settings > Privacy > My Health Data, or email info@peakmindmechanics.com. We verify requests through your logged-in account; if you write from outside the app, we may ask you to confirm through your account. Requests are free.

Timing. We respond within 45 days. If we need more time, we’ll tell you why within those 45 days and finish within 45 more. Deletion from live systems happens within that window. Deletion from backup systems happens within 6 months, and we don’t restore deleted data in the meantime.

What we keep after deletion. We keep a minimal record that you gave or withdrew consent, and that we completed your request, so we can prove we followed the law. That record contains no health data.

Appeals. Write to info@peakmindmechanics.com with “Appeal” in the subject within 45 days of our decision. We’ll answer in writing within 45 days with our reasons. If we deny your appeal, you can contact the Washington Attorney General at atg.wa.gov or the Nevada Attorney General at ag.nv.gov.

We will never deny you service, charge you more, or give you a lower-quality service because you exercised these rights.

6. How we protect it

Access to consumer health data is limited to the people and service providers who need it to run Peak Mind, and access through our admin tools is logged. Data is encrypted in transit and at rest. Our service providers must meet the same standards by contract.

7. De-identified data

Data is de-identified only when it can’t reasonably be linked to you. We take reasonable technical measures to ensure that, we commit publicly here not to re-identify it, and we contractually bar anyone who receives it from re-identifying it. The optional “Commercial models & licensed datasets” setting uses only de-identified data meeting this standard. For users in Washington, Nevada, Connecticut, and Maryland, it excludes health-derived data entirely.

8. Age

Peak Mind is for adults 18 and older. If we learn that an account belongs to someone under 18, we freeze it and delete its data. If a birth date on file looks like an entry error, we freeze the account and ask the account holder to confirm their birth date before deciding.

9. Changes to this policy

We review this policy at least once a year and whenever we change how we handle consumer health data. We’ll tell you about material changes in the app before they take effect. We won’t use consumer health data for a new purpose without asking for your consent first. The effective date at the top shows when this policy last changed.
