Terms of Use

Version 2.0 — replaces Version 1.0 (March 20, 2026). The trust-first revision adds Section 9 (Privacy & Data) clarifying that nothing in these Terms grants research-use rights, and that all AI providers operate under zero-retention agreements. Research participation is offered separately, inside the Service.

1. Acceptance of Terms

By creating an account or using Peak Mind Coach (the “Service”), operated by Peak Mind Mechanics® (“Company,” “we,” “us,” or “our”), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the Service.

2. Scope-of-Practice Disclaimer

Peak Mind Coach is a mental performance coaching and self-development platform. It is not a medical service, psychotherapy service, or mental health treatment program. The content, tools, assessments, and coaching provided through the Service are intended for educational and performance development purposes only.

If you are experiencing a mental health crisis, diagnosable condition, or require clinical support, please consult a licensed mental health professional. Use of this Service does not create a therapist-client, physician-patient, or any other clinical relationship.

3. Eligibility

You must be at least 13 years of age to use the Service. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

4. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information when creating your account and to notify us immediately of any unauthorized use.

5. Subscriptions and Billing

Paid subscriptions are billed on a recurring monthly or annual basis via Stripe. You may cancel at any time; cancellation takes effect at the end of the current billing period. You can manage your subscription, update payment methods, and view invoices through the Stripe Customer Portal, accessible from your Settings page. Refunds are not issued for partial billing periods. We reserve the right to modify pricing with 30 days' notice.

6. Intellectual Property

All content on the Service — including the ReFrame framework, BTE methodology, assessments, tools, and written materials — is the exclusive intellectual property of Peak Mind Mechanics® and Steve Vasco. You may not reproduce, redistribute, or create derivative works without express written permission.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Peak Mind Mechanics® shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Termination & Account Deletion

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms, engage in abusive behavior, or misuse the Service. You may delete your account at any time from the Settings page. Deletion is permanent and removes your profile, assessment history, tool progress, connections, and all associated data.

9. Privacy & Data

Your privacy is governed by our Privacy Policy, which describes what we collect, why, who can see it, how to control sharing, and how to delete your data. Three commitments specific to research and AI use are summarized below; the full detail lives in the Privacy Policy.

9.1 No third-party AI training. We do not, and will not, permit any third-party AI provider to use your interactions with the Service to train, fine-tune, or otherwise improve their models. Every AI provider we use operates under contractual or default zero-retention terms that prohibit such use.

9.2 Research participation is offered separately. Nothing in these Terms grants Peak Mind Mechanics® rights to use your data to train, fine-tune, or otherwise improve our own AI or coaching models. Research participation is offered through a separate set of granular toggles inside the Service's Settings (“Research & Privacy”). You decide whether and to what extent to contribute, scope by scope. Default state for every research scope except anonymous cohort benchmarks is opt-in only. You can change any setting at any time, and changes take effect for future use of your data.

9.3 Granular sharing control with paired humans. When you connect with a Leader or Engineer, you control which categories of your data they can see — assessments, readiness, tool progress, goals, reflections — through granular toggles in Settings, independent of the research toggles in §9.2. You can revoke any of these at any time, and revocation takes effect immediately.

10. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of Santa Clara County, California.
